Interpretation generally

Section 3 sets out the general rules for interpreting key concepts used throughout the Social Welfare Consolidation Act 2005, including how age is determined, what counts as a contribution, who qualifies as an employer, how adoption affects a child's status, and how the terms "spouse" and "civil partner" are defined for benefit purposes.

  • A person's age for benefit purposes is determined strictly by reference to the anniversary of their date of birth, and regulations may adjust the precise timing within a contribution week for the purpose of calculating contributions.
  • Any unqualified reference to "contributions" in the Act covers employment contributions, self-employment contributions, and voluntary contributions; references to an employed contributor's employer relate only to insurable employment.
  • Where a child is adopted (whether domestically or through an intercountry adoption recognised in Ireland), the child is treated as the child of the adopter(s) and not of any other person, which can affect orphan status and related entitlements.
  • For many benefit-related sections of the Act, "spouse" means each person in a married couple living together and "civil partner" means each partner in a civil partnership living together; however, former spouses and former civil partners whose dissolution is recognised in the State may still count as a "qualified adult" for the purpose of benefit increases.
